SMS Compliance Policy

Opt-in requirements, opt-out procedures, anti-spam policy, and SMS best practices

Text R Us LLC (DBA My Text R Us) is committed to full compliance with applicable U.S. carrier messaging requirements, the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles, and industry best practices. This page explains the rules every business user must follow when sending SMS communications through our platform. You may only send messages to recipients who have explicitly opted in to receive communications.

Opt-In Process / Message Flow

Customers subscribe using one of two opt-in methods: a website opt-in form or a Text-to-Join keyword. No contact is added to a list or sent any messages without explicit, verifiable opt-in consent. The SMS consent checkbox is unchecked by default and must be manually selected by the user. At the point of opt-in, the following disclosure is presented: "By checking this box, I agree to receive recurring marketing text messages from Text R Us LLC (DBA My Text R Us). Message frequency varies. Message & data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent is not a condition of purchase."

Method 1: Website Opt-In Form

The website opt-in workflow operates as follows:

  1. The customer visits the business website and completes a registration or sign-up form.
  2. The customer enters their mobile phone number in the provided field.
  3. The customer manually checks the unchecked SMS consent checkbox, which displays the full marketing opt-in disclosure.
  4. The customer submits the form. The phone number is added to the business's contact list as "subscribed."
  5. A consent log entry is recorded with the source "web_form," the IP address, and a timestamp.
  6. The contact can reply STOP to any message at any time to opt out.

Method 2: Text-to-Join Keyword

The keyword opt-in workflow operates as follows:

  1. The customer texts one of the opt-in keywords — START, UNSTOP, JOIN, YES, or SUBSCRIBE — to the business's dedicated messaging number.
  2. The platform processes the incoming message and adds the phone number to the business's contact list as "subscribed."
  3. The platform sends a confirmation message confirming the customer has been added to the marketing list.
  4. A consent log entry is recorded with the source "sms_keyword," the keyword used, the incoming message SID, and a timestamp.
  5. The contact can text STOP to the business number at any time to opt out.

1. Opt-In Requirements

Before sending any SMS message to a contact, you must obtain explicit, verifiable opt-in consent. Acceptable opt-in methods include:

  • Website opt-in form: The contact checks an unchecked consent box and submits their phone number through an online form on the business website. The form clearly states they are agreeing to receive recurring marketing text messages from Text R Us LLC (DBA My Text R Us).
  • Text-to-Join keyword: The contact texts a keyword — START, UNSTOP, JOIN, YES, or SUBSCRIBE — to the business's dedicated messaging number to opt in. The platform confirms subscription and logs the consent event.

At the point of opt-in, you must clearly disclose: (a) the business name, (b) the type of messages the contact will receive, (c) the expected message frequency, (d) that message and data rates may apply, and (e) that consent is not a condition of purchase. The consent checkbox must not be pre-checked — the customer must actively check the box before submitting. You must retain proof of consent for each contact and be able to produce it upon request.

2. What Is Not Valid Consent

  • Purchased or rented phone number lists — consent is not transferable.
  • Pre-checked boxes on web forms — consent must be an affirmative action.
  • Consent buried in long terms and conditions without clear disclosure.
  • Assumed consent from an existing customer relationship without explicit SMS opt-in.
  • Scraped or harvested phone numbers from public sources.

3. Opt-Out Procedures

Every SMS message you send must include clear opt-out instructions. My Text R Us automatically processes the following opt-out keywords:

  • STOP / STOPALL — Unsubscribes the contact from all future messages.
  • UNSUBSCRIBE — Same as STOP.
  • CANCEL, END, QUIT — Also recognized as opt-out.

When a contact opts out, they are immediately flagged as unsubscribed and excluded from all future campaigns. You must not attempt to re-add an opted-out contact or send them additional messages without obtaining fresh, documented consent. Opt-out requests must be honored within the same business day.

4. HELP Keyword Support

My Text R Us automatically responds to the HELP and INFO keywords with a message containing your business name, support contact information, and a reminder that the contact can reply STOP to opt out. This ensures compliance with carrier requirements for consumer assistance.

5. Anti-Spam Policy

My Text R Us maintains a zero-tolerance policy for spam. The following practices are strictly prohibited and may result in immediate account suspension:

  • Sending messages to contacts who have not opted in.
  • Sending messages to contacts who have opted out.
  • Using misleading sender names or deceptive message content.
  • Sending excessive or unreasonable message frequency beyond what was disclosed at opt-in.
  • Attempting to bypass carrier filtering or opt-out processing.
  • Sharing opt-in consent across multiple brands or businesses without separate consent for each.

6. Message Content Requirements

  • Every campaign message must include clear identification of the sending business.
  • Messages must include opt-out and help instructions (e.g., "Reply STOP to opt out. Reply HELP for help.").
  • Message content must match the category disclosed during campaign registration.
  • Prohibited content categories (illegal drugs, weapons, adult content, hate speech, fraud) are not permitted under any circumstances.

7. SMS Best Practices

  • Send during business hours: Limit messages to reasonable hours (typically 8 AM – 9 PM in the recipient's local time zone) to comply with TCPA restrictions.
  • Respect message frequency: Only send as often as the contact agreed to at opt-in. Excessive frequency leads to higher opt-out rates and carrier filtering.
  • Keep messages relevant: Send content that matches what the contact signed up for. Irrelevant messages damage trust and increase spam reports.
  • Monitor opt-out rates: High opt-out or spam report rates can trigger carrier penalties. Review your metrics regularly.
  • Use clear, concise language: SMS has a 160-character limit per segment. Keep messages short and actionable.
  • Include your business name: Recipients should immediately know who the message is from.
  • Test before sending: Use the test send feature to verify message formatting and content before launching a campaign.
  • Maintain clean lists: Regularly remove bounced, invalid, and opted-out numbers from your contact lists.

8. Carrier Registration Compliance

All business users must complete the carrier registration process, which includes verifying your business with applicable carrier registries. This involves:

  • Providing accurate business information (EIN, legal name, address, contact details).
  • Registering each messaging campaign with an appropriate use case category.
  • Using a verified, assigned business phone number (local or toll-free).
  • Maintaining opt-in records and complying with carrier audits.

Failure to complete carrier registration will prevent you from sending messages. Sending without proper registration may result in carrier blocking and account suspension.

9. Enforcement

My Text R Us actively monitors message traffic for compliance. Violations of this policy may result in warnings, message blocking, campaign suspension, account suspension, or permanent termination. We cooperate with carriers and regulatory authorities in investigations of suspected non-compliance.

10. Message Frequency

Message frequency varies depending on the business sending messages. Each business determines its own sending cadence based on the program type and what was disclosed at the point of opt-in. Recipients should refer to the original opt-in disclosure for expected frequency.

11. Fees

Message and data rates may apply. Recipients should consult their mobile carrier for details about their messaging plan and any associated fees.

12. Prohibited Uses

The following practices are strictly prohibited on the My Text R Us platform:

  • Purchased contact lists — consent is not transferable and purchased lists do not constitute valid opt-in.
  • Cold texting — sending messages to individuals with no prior relationship or consent.
  • Spam — sending unsolicited bulk messages.
  • Unsolicited marketing — promoting products or services to recipients who have not opted in.
  • Messaging without documented consent — every recipient must have a verifiable opt-in record before any message is sent.

13. Messaging Program Description

Text R Us LLC (DBA My Text R Us) is an Independent Software Vendor (ISV) providing a direct SMS marketing offering. Text R Us LLC (DBA My Text R Us) operates the mytextrus.com platform, which businesses use to send marketing and promotional SMS messages to their own opted-in customers. Businesses (Text R Us LLC customers) register for an account, complete business verification, and obtain a dedicated business messaging number. Only recipients who have explicitly opted in receive SMS messages — no messages are sent to recipients who have not provided prior express consent. Recipients are customers and subscribers who have provided prior express consent through website opt-in forms or by texting a Text-to-Join keyword (START, UNSTOP, JOIN, YES, or SUBSCRIBE) to the business number. All messages are marketing and promotional in nature, including special offers, discounts, sale announcements, and promotional campaigns. Message frequency varies. Message and data rates may apply. Recipients may reply STOP to opt out or HELP for assistance. Purchased, rented, or scraped contact lists are strictly prohibited.
